1. General Terms
Hall & Ca, SA, here named as 'Seller', promotes and sells snug garments on www.snug.com.pt.

The 'Buyer' is the person who buys in the quality of final consumer, excluding the sphere of any commercial or business use. If you are not a 'final consumer' please do not buy on www.snug.com.pt.

The 'Seller' reserves the right to not to accept orders recorded on www.snug.com.pt if there are doubts about the quality of the final 'Buyer' or if orders do not follow the terms and conditions presented on this section. These conditions and general terms of business rule exclusively the offer, the acceptance of orders, the transmission and shipments made on www.snug.com.pt.

The 'Buyer' shall provide the 'Seller' all his/her correct and complete data (eg, address or email address) and shall accept that the 'Seller' may contact him/her if required using this data.

2. Right not to accept/cancel an order

The 'Seller' reserves the right to cancel any order, even if already confirmed, in the following cases, exempt from responsibility for any payment or fees:
• The item is no longer available (the payment will be refunded);
• The invoice information is not correct or invalid;
• The order is reported by our Security System as an invalid or fraudulent order;
• The payment is not received within two days after its' registration;
• If the consumer is under 18 years old;
• If there is any indication that the consumer is not a final consumer;
• If the prices of the articles displayed on the website are not correct;
• If it is not possible to deliver the order at the address provided at the order registration.

3. Data verification
All orders' information will be checked, particularly regarding the delivery address, the credibility of consumer data and check fraud. All suspected fraud will be reported to the authorities.

4. Payment methods
We only accept the payment method available on the website and listed on the / Help FAQS section on www.snug.com.pt.

5. Payment processing
Order processing will start after receiving its’ payment. If payment for a reference has not been received two days following the order registration, stock existence of the ordered item(s) may be affected. Payments will not be accepted if the billing information is not valid.

6. Security
Your payment information is encrypted at Paypal until your transaction is processed, and will not be saved on a public server. Although we use secure software, the security of payments via internet can not be fully certified. snug will not be obliged to any compensation for damages resulting from the use of electronic media. Payments can only be processed if the billing information can be verified.

7. Subject Property 
Hall & Ca, SA owns the company's products until the company has received full payment of all the ordered products.

8. Price 
8.1. The total price 
The total price displayed when proceeding to order payment includes all taxes and shipping. Shipping charges are applied per order. Prices are quoted in the order confirmation, which you can print or download for future use. For more information on the shipping costs, check Help / FAQs section on this website.

8.2. Price changes 
The products' prices on the site may be changed at any time. The 'Seller' reserves the right to change prices without notifying the 'Buyer'. The current prices are the ones displayed when the order is placed.

8.3 . Price errors
Please note that even though the website is thoroughly updated, it is possible that the items’ prices featured on the site have errors.

9 . Quality and Warranty
The 'Seller' does not sell used products, damaged garments or items with an inferior quality according to snug's quality standards. On each product page, you have the main features of each product listed on www.snug.com.pt. It is possible that garments for sale on the website do not exactly match the real product in terms of image and colors due to the Internet browser and the screen the user has.

Each item has an authentication hangtag. Do not cut this tag if you want to return a purchased product. The 'Seller' has the right not to accept product returns without their own labels or if it is verified that the items have been changed or damaged in comparison to their original state.

10. Shipping and Delivery
10.1 Delivery
We deliver products from Monday to Friday, except on national holidays. We are unable to guarantee delivery of an order if the address has been typed incorrectly.

Delivery is considered completed once signed upon delivery at the provided address, which can be a home or an office address.

10.2 Delivery period
Delivery: up to 5 working days. Delivery usually takes place in 48 hours. The 'Seller' uses an external logistics company, FEDEX for deliveries, and this company’s availability may delay the delivery time. Weekends and holidays are not considered business days and consequently deliveries may be delayed.

The 'Seller' will not be held responsible for disobedience or delay in compliance with any obligation resulting from a major event (event, act or omission) out of control of the 'Seller'.

10.3. Inspection at delivery
At delivery, the 'Buyer' shall inspect the package to check any possible damage. If the products are damaged, the client shall not accept the order and must return it to us. The 'Seller' will refund the amounts paid for the returned items when the return reaches our warehouse and the return process has been concluded.

After receiving the order, it is important that 'Buyer' examines the goods delivered within 15 days as the "Seller" considers that 'Buyer' has accepted the product(s) if he/she does not return it/them within the referred period.

11. Shipping Costs
Shipping charges are applied per order and the exact price of national shipping to Madeira and Azores is 5,70 euros by Correio Verde and each international shipment by our courier FEDEX is from 10 euros and may vary depending on the destination country. This price will be displayed before the order payment.

12. Returns and Cancellations 
12.1. Cancel the order before shipment 
The 'Buyer' may cancel any order that has not yet been shipped at no cost to the customer. If the 'Buyer' places an order and then wishes to cancel it, he/she will have to contact our Customer Service and request the cancellation of the order. If the cancellation request is accepted, the 'Buyer' will be notified by e-mail and the cancellation will be processed free of charges to the customer. In case it is impossible to cancel the products, these will be shipped to the customer. Thus, if the 'Buyer' still wants to cancel his/her order, he/she will have to refuse reception at delivery. Items will be returned to our warehouse and we will refund the amount upon receipt.

We underline that the 'Buyer' is responsible for the return shipping costs.

12.2. Return defective products 
The 'Buyer' has the right to return delivered items if he/she notices any defects or damages on the ordered products. The refund will be made within 14 days of the date on which we are informed of product return decision, including the costs of delivery of the goods in accordance with paragraph 2 of article 13 of Law Decree 24/2014 February 14. 12.3 Return of products by rejection 
If for any reason, the 'Buyer' is not satisfied with the ordered items, returns are accepted within 14 days following delivery, provided that:

• items have not been washed or worn: the 'Buyer' can try on the clothes to check the size and shape but cannot wear them;

• the article keeps its' original features and the original packaging is not damaged;

• the product is complete (eg. both parts of an outfit must be returned);

The 'Buyer' cannot return garments that have been changed or whose hang labels are damaged.
We underline that the 'Buyer' is responsible for the return shipping costs.

12.4. Exchange 
It is currently impossible to make any exchanges of one or more articles. The 'Buyer' will have to return unwanted garments for refund. If the customer wants to buy the same item in another color or a new product, a new order will have to be placed.

12.5. Refunds
Refunds are made through PayPal as soon as the product(s) reaches (reach) our warehouse. For more information on returns and refunds, visit the Help/FAQs section on the website.

14. Availability 
The satisfaction of all orders placed on the webstore depends on the items’ availability. The 'Seller' tries to ensure that all items sold on-line are available in stock. Nevertheless, the 'Seller' reserves the right to refuse or cancel any orders (even if already confirmed) if the order includes unavailable products. In such cases, the 'Seller' will inform the 'Buyer' and will refund the amount of the missing item(s).

15. Validity of the Sale
Offers on the site are valid only for the time they are displayed on the site, unless contrary information is published on the site. The 'Seller' is not attached to any offer. In case of spelling mistakes on prices or other information contained on the website, the 'Seller' reserves the right to cancel any on-going sale.

16. Responsibility
The 'Seller' will not be liable for damages suffered by the client if they result from violations of contractual obligations due to 'Seller' with respect to the client, or if the responsibility of the 'Seller' results of the legal right.
The responsibility of the 'Seller' shall be limited:
• to damaged snug garments;
• maximum compensation refund which will be the amount spent on the ordered garments.

The 'Seller' will not be liable for damages to third parties arising from the use of any of our items or damages suffered by the customer due to incorrect use of our items.

If the 'Buyer' suffers damages resulting from gross negligence or willful misconduct by the 'Seller', none of the limitations contained in this Article shall apply.

17. Applicable Law 
These terms and conditions and all disputes arising which relate to these general conditions, including the validity of the use of the site or any purchase, shall be governed by Portuguese law.

18. Change of Terms and Conditions by the 'Seller' 
The 'Seller' has the right to change these terms and conditions at any time. The 'Buyer' shall follow the principles and terms featured when he/she places the order, unless law or any authority forces changes.

19. Information on the website 
Although the 'Seller' pays particular attention to the creation of the website, its’ texts, movies, music and other services may contain errors or be incomplete. The 'Seller' cannot be held legally responsible for any damages resulting from the use (or inability to use) the Site, including damage caused by a virus or any inaccuracy or inadequacy of information, unless such damage resulted from the negligence on the part of the 'Seller'.

20. Trademarks and copyright on the website
All brand names, product names and titles used on this website are trademarks or trade names of the 'Seller'. You are not allowed to use of reproduce any such trademarks or trade names as this may represent an infringement of the holders' rights. You may only electronically copy and to print in hard copy portions of the Website to the extent this is necessary for the purpose of placing an order with us. You are not allowed to make any other use of the information and materials on this website. In case you wish to use materials or information from this Website, you need to obtain a prior consent from the 'Seller'.
